Breaching an AVO

While having an AVO against you does not result in a criminal record, breaching an AVO is a criminal offence. The penalties for a breach of an AVO can be severe, up to 2 years gaol. In particular, if an AVO is breached by violence, the law provides that the penalty must be gaol unless there are exceptional circumstances.

If you believe that a person has lied about what happen in order to get an AVO against you then you might want to think carefully before just agreeing to it being made. If they had lied once is there a risk that if you agree to the AVO they will lie again to police by saying that you had breached it?
